In these Terms and Conditions (“Terms”):

  • “Client”, “You”, or “Your” refers to the person or business engaging Lifted Marketing’s services.

  • “We”, “Us”, “Our”, or “Lifted Marketing” refers to Shea Rafferty trading as Lifted Marketing (ABN 85 785 295 510).

  • “Services” means any digital marketing, content creation, SEO, or related work provided by Lifted Marketing.

2. Scope of Services

Lifted Marketing provides digital marketing and content management services including, but not limited to:

  • Google Business Profile management and optimisation.

  • Social media content creation, posting, and engagement.

  • Local SEO assistance and analytics reporting.

We may modify or discontinue any Services without notice.
Lifted Marketing does not guarantee specific business outcomes such as sales, leads, or engagement levels.

3. Fees and Payments

  • All Services are billed yearly, on a monthly subscription basis, payable in advance.

  • Payments are accepted via Stripe, PayPal, or bank transfer or as agreed.

  • All prices are in Australian Dollars (AUD) and include GST where applicable.

  • Late or missed payments may result in suspension or cancellation of Services.

  • Lifted Marketing reserves the right to adjust pricing with 14 days’ written notice.

4. Cancellations and Refunds 

  • Lifted Marketing may terminate Services with reasonable notice if the Client breaches these Terms or engages in unlawful or unethical conduct.

5. Client Responsibilities

You agree to:

  • Provide accurate and timely information required to deliver the Services.

  • Supply all relevant assets (e.g. logos, images, and text).

  • Obtain any necessary rights or permissions for content you provide.

Lifted Marketing is not responsible for delays or outcomes caused by incomplete or incorrect information from the Client.

6. Intellectual Property

  • All designs, reports, and templates created by Lifted Marketing remain our property until payment is received in full.

  • Once payment is made, you receive a non-exclusive, non-transferable licence to use those materials for your business marketing purposes only.

  • You may not resell or distribute our materials to third parties without written consent.

  • Lifted Marketing reserves the right to showcase non-confidential work examples (e.g. social posts) in our portfolio or marketing.

7. Confidentiality

Both parties agree to maintain the confidentiality of all non-public information obtained during the working relationship, except where required by law.

8. Limitation of Liability

To the maximum extent permitted by law, Lifted Marketing, its employees, and contractors are not liable for any direct, indirect, incidental, or consequential losses or damages arising from the use of our Services or website.
Our total liability for any claim shall not exceed the total amount paid by the Client for Services in the month in which the claim arises.

9. Indemnity

You agree to indemnify and hold harmless Lifted Marketing, its owners, and employees from any claims, damages, or expenses (including legal fees) resulting from:

  • Your breach of these Terms.

  • Your misuse of our materials or Services.

  • Your violation of any law or third-party rights.

This indemnity continues after termination of Services.

10. No Guarantee

Lifted Marketing provides Services based on best practices and current marketing knowledge but makes no guarantee of specific results such as sales, traffic, or leads.
Results depend on various external factors outside our control.

11. Force Majeure

Lifted Marketing shall not be liable for any delays or failures in performance caused by events beyond our control, including but not limited to natural disasters, internet outages, platform downtime, or government restrictions.

12. Governing Law

These Terms are governed by the laws of Western Australia. Any disputes will be handled in the courts of Western Australia.
